  Dear OSA Members,

The OSA Election Committee has reviewed all the nominations received
postmarked by February 14, 2011.
Here are the list of candidates:

Secretary: Leena Mishra
Treasurer: Sushant Satapathy

Since there were no other nominations for the posts of Secretary and
Treasurer there will NOT be a contest for these positions.

For the position of President and Vice-President (President and
Vice-President are on the same slate) there be a contest.
A vote for a presidential candidate will imply a vote for his/her running mate.

The candidates are:

Annapurna Pandey, President and Kuku Das, Vice-President

Amar Pani, President and Anjalie Joshi, Vice-President

Election ballots will be mailed to members during the 3rd week of
March 2011. Any correspondence on the election subject will be
electronic (via email) only. All emails on this subject must be sent
to OSA.Election2011@gmail.com. We are looking forward to a successful
election in 2011.

Because of the delay in the US post office we received a new set of
nomination. The nomination was sent before the deadline.

The final slate of candidates for the position of President and Vice
Presidents

will be mailed to members during the 3rd week of March 2011. Any
correspondence on the election subject will be electronic (via email)

There have been some questions recently about the validity of the
candidacy of Ms. Anjalie Julie Joshi for Vice-President.
In the interests of transparency, 2011 election committee would like
to provide the following explanation about the above matter.

he election committee was aware of the fact that candidate for VP
position of Ms. Anjalie Julie Joshi became a life
member of OSA on February 14th, 2011, the deadline for filing the nomination.

The Election Committee, in good faith, have applied the OSA
constitution as written. Eligibility is based on Article V, Section 3
as stated below.

"The President, Vice President, Secretary and Treasurer shall be
elected for a term of two years. These four executive officials must
be life members or patrons or benefactors of OSA in good standing and
must be 21 years of age or over. "

Please note that there is no mention of date as of which the status of
life member must be attained. One reasonable interpretation of this is
that the status is as of the date of nomination scrutiny. The other
reasonable interpretation is that prescribed for qualification to vote
i.e. "a list of members who have paid their dues by Dec. 31 of the
year preceding the election year."

 In the absence of clarity in the constitution the Election Committee
have gone with the
first interpretation for the following reasons:
1) In the case of unclear guidelines the benefit of doubt should go to
the candidate.
2) The ballot is the surest way for all 875 eligible voting members of
OSA to express their opinion of the candidate best qualified to
represent them.
3) A candidate only needs to be a life member in good standing by the
time he/she assumes office to be effective.

Eligible voters will be still be determined as dictated by the by laws
as "a list of members who have paid their dues by Dec. 31 of the year
preceding the election year". This may have the unintended consequence
of a paradoxical situation where we have a valid candidate who is not
eligible to vote as the name is not listed in the voters' list.

Here is the section 3 of BY-LAW III: ELECTION PROCEDURE
Section 3
The Secretary of the OSA shall prepare a list of members who have paid
their dues by Dec. 31 of the year, preceding the election year. This
list along with the list of life members and patrons shall be
submitted to the chairman of the election committee by Jan. 15 of the
election year.

We hope that the General Body and the next set of office bearers will move
to amend the "By Laws" to clarify this ambiguous situation. We have also
informed our decision to the OSA General Counsel Mr. Sujit Mohanty and
Advisory Council member Mr. Nick Patnaik. We are looking forward to a
successful OSA Election in 2011.

Dear OSA member and OSA BOG member
If you have been an OSA life/annual  member before 12/31/10 please
check that your membership details are correct on the DOLA system. As
our ongoing verification of the voter list we will check multiple
sources of information including the DOLA system. Making sure that
there are no errors or omissions from DOLA will help us guarantee that
we miss no one who should receive a ballot. If in case you feel that
you have been left out please contact OSA secretary and us at the
earliest with documentation of joining OSA before 12/31/10.

BOG members please help ensure that all members of your chapter are on
the DOLA system correctly.  Please spread the word to your chapter
members especially those who do not use OSA net.

                                 To ensure the validity and integrity of the voters list EC has recently conducted a teleconference with all the presidential and vice presidential candidates. For transparency of the election process, the minutes of this teleconference, as agreed by all parties, is included below.

Minutes of Meeting (Teleconference)

Time: 9:30 p.m. -10:30 p.m. March 10, 2011

Attendees: A. Pandey, K. Das, A.K. Pani, A. J. Joshi, D. Misra, H. Padhi, A. Patra

               

EC:  To assure the integrity of the voter list provided to EC by Ms. Pandey in her capacity as Secretary before she was nominated for the position of president EC are undertaking several measures that the EC wishes to share with you. The OSA constitution says that once nominated an office-bearer should not take any further part in election related matters. Ms. Pandey has done so by resigning as soon as she was nominated.

To make sure that the list was as correct as possible EC has taken the following measures:

a) checked with the Treasurer and the new Secretary on the steps taken to generate the list -- the treasurer is responsible for accepting the money and entering the names of members in DOLA systems and maintaining it – hence opportunity for modification by anyone else is minimal;

b) checked the list provided us with the online records;

c) solicited input from members and chapter leaders etc;

d) requested a fresh list for verification only, from new secretary.... (now received and verified);

e) EC has also provided both the presidential candidates with a copy of the list and their input on any errors or omissions.

In light of all of these precautions, EC believes the integrity of the voter list is extremely high.

EC believes that if the integrity of the list is not unanimously agreed then election process should be restarted.

Candidates were asked if they had any concerns about the integrity of this list.

 

All the candidates confirmed that they were satisfied with the list.

 

1.      1. During the discussion Ms. Pandey clarified that the list she provided was consistent with the one stored in the DOLA system that is open to public. She also confirmed the process and the role of treasurer maintaining the DOLA system.

2.     2. Mr. Pani commented that no votes should be accepted from anyone outside the list.

3.     3.  Mr. Pani objected to Ms. Pandey circulating campaign materials listing the unanimously elected (uncontested) Secretary and Treasurer as part of their team. Ms. Pandey agreed to retract that statement. (She has subsequently done so in OSAnet.)

4.     4.  Mr. Pani requested that the ballot template be circulated to all candidates prior to printing. (EC had done so and the candidates’ recommendations were considered as well.)

5.     5.  All candidates appreciated the hard work of the EC and expressed confidence in the integrity of the election process.

ballots as soon as possible in the provided envelop. EC will accept ballots postmarked no later than April 25. Please send ballots by regular first class mail. Sending it by express mail and/or any other means that require someone to sign for them may cause your ballot to be returned since the PO Box cannot receive such mail. Please note that each ballot is individually coded -- DO NOT LEND YOUR BALLOTS to others and or make photocopies to replace lost ballots. In case you lose your ballot please contact EC at the earliest and EC will invalidate the old one and issue a new one to you.
